In this paper I argue that, according to a particular physicalist conception of information, information is both alethically neutral or non-alethic, and is intrinsically semantic. The conception of information presented is physicalist and reductionist, and is contrary to most current pluralist and non-reductionist philosophical opinion about the nature of information. The ontology assumed for this conception of information is based upon physicalist non-eliminative ontic structural realism. However, the argument of primary interest is that information so construed is intrinsically semantic on (...) a reductionist and non-alethic basis where semantic content is constituted by indication along causal pathways. Similar arguments have been presented by philosophers with respect to representation. I suggest the conception of information that I present is correct by the lights of the best applied mathematical and scientific theories of information. If so, there is no need for any separate theory of semantic information. Thus I present a theory of intrinsically semantic information which also constitutes an informational theory of truth where truth reduces to information. In the last section I discuss weakly and strongly semantic information, and reject them in favour of alethically neutral intrinsically semantic information. (shrink)

I argue that although Ockham’s Razor (OR) has its origins in a-priorist ontological mandates according to the purposes of natural theology and natural philosophy as influenced by it, the principle has taken on significant empirical and contingent materialist connotations and conceptual content since the scientific revolution. I briefly discuss the pluralism of the concept of OR historically and in contemporary science and philosophy. I then attempt to align scientific metaphysics with contemporary conceptions of OR, and to demonstrate that ontic parsimony (...) is an indispensable element of scientific (contingent and anti-a-priorist) metaphysics. I then further deploy that scientific metaphysics to propose a contingently grounded semi-formal approach, with set theoretic features, and then with information theoretic features, to provide a way of assessing when a scientific theory and its ontology are aligned with OR appropriately in the context of the proposed scientific metaphysics. The objective of this thesis is to present a naturalised metaphysics of information, or to naturalise information, by way of deploying a scientific metaphysics according to which contingency is privileged and a-priori conceptual analysis is excluded (or at least greatly diminished) in favour of contingent and defeasible metaphysics. The ontology of information is established according to the premises and mandate of the scientific metaphysics by inference to the best explanation, and in accordance with the idea that the primacy of physics (...) constraint accommodates defeasibility of theorising in physics. This metametaphysical approach is used to establish a field ontology as a basis for an informational structural realism. This is in turn, in combination with information theory and specifically mathematical and algorithmic theories of information, becomes the foundation of what will be called a source ontology, according to which the world is the totality of information sources. Information sources are to be understood as causally induced configurations of structure that are, or else reduce to and/or supervene upon, bounded (including distributed and non-contiguous) regions of the heterogeneous quantum field (all quantum fields combined) and fluctuating vacuum, all in accordance with the above-mentioned quantum field-ontic informational structural realism (FOSIR.) Arguments are presented for realism, physicalism, and reductionism about information on the basis of the stated contingent scientific metaphysics. In terms of philosophical argumentation, realism about information is argued for primarily by way of an indispensability argument that defers to the practice of scientists and regards concepts of information as just as indispensable in their theories as contingent representations of structure. Physicalism and reductionism about information are adduced by way of the identity thesis that identifies the substance of the structure of ontic structural realism as identical to selections of structure existing in re to combined heterogeneous quantum fields, and to the total heterogeneous quantum field comprised of all such fields. Adjunctly, an informational statement of physicalism is arrived at, and a theory of semantic information is proposed, according to which information is intrinsically semantic and alethically neutral. I will analyse Floridi’s rejection of digital ontologies and his positive proposal for an informational structural realism. I intend to show that ISR is still fundamentally a digital ontology, albeit with some different metaphysical commitments to those that Floridi rejects. I will argue that even though Floridi deploys the method of levels of abstraction adapted from computer science, and has established a Kantian transcendentalist conception of both information and structure, ISR still reduces to a discretised binary, and therefore digital, ontology. (...) The digital ontologies that Floridi rejects are John Wheeler’s “It from Bit” conception and computational metaphysics. They’re rejected predominantly on the basis that they rely upon a false dichotomy between digital discrete and continuous metaphysics. ISR involves a Kantian transcendentalist conception of de re relations that is intended to avoid this false dichotomy. However, I’ll argue that the binary, discrete, digital component of digital ontology is retained in ISR, and therefore ISR is still a digital ontology since its conception of information reduces to binary discrete de re relations. As such, ISR comes down on one side of the rejected ontic dichotomy of digital metaphysics, and so an informational metaphysics that is not a digital ontology is still a promissory note in the philosophy of information. Genesis 16 tells of Abraham conceiving Ishmael with his wife Sarai's servant Hagar. Dominican Friar Richard Fishacre (ca. 1200-1248) used this Biblical narrative to explore the relationship of the natural and Divine sciences. Fishacre believed that the theologian must first study the world, before he could be fruitful as a theologian. How do the natural sciences, in short, help us better understand the Scriptures? Fishacre, like his contemporaries Albert the Great (ca. 1200-1280) and Thomas Aquinas (1225-1274) looked at ways that (...) the newly-translated natural philosophy of Aristotle, with its empirical emphasis and a belief that knowledge begins in sense perception, could supplement the more otherworldly Neoplatonic approach to philosophy and the sciences inherited from St. Augustine. Hagar's Vocation is a collection of fifteen essays which focus on the contributions of Richard Fishacre, the first Dominican theologian at Oxford to have left a written legacy. The questions addressed by Fishacre include his arguments for God's existence, the multi-faceted problem of the human soul, the eternity of the world, the nature of light, the free choice of the will, angels and "spiritual matter," interiority and self-knowledge, undoing the past and God's absolute power, the magical arts, and the role of philosophy in a theology of creation. R. James Long, the world's leading authority on Fishacre, in this volume promises to establish this hitherto little studied English friar as a major figure in the development of a learned or philosophically grounded theology that remains the great achievement of High Scholasticism. This study examines the relationship between procedural justice and employee job insecurity, and the boundary conditions of this relationship. Drawing upon uncertainty management theory and ethical leadership research, we hypothesized that procedural justice is negatively related to job insecurity, and that this relationship is moderated by ethical leadership. We further predicted that the moderating relationship would be more pronounced among employees with a low power distance orientation. We tested our hypotheses using a sample of 381 workers in Macau and Southern (...) China. The results support all of our hypotheses. This book investigates the interplay between two new and influential subdisciplines in the philosophy of science and philosophy: contemporary scientific metaphysics and the philosophy of information. Scientific metaphysics embodies various scientific realisms and has a partial intellectual heritage in some forms of neo-positivism, but is far more attuned than the latter to statistical science, theory defeasibility, scale variability, and pluralist ontological and explanatory commitments, and is averse to a-priori conceptual analysis. The philosophy of information is the combination of what has (...) been called the informational turn in philosophy and ontology, with the informational turn in logic. The book explores the intersecting theoretical commitments and metaphysical basis of both. It applies scientific metaphysics to the philosophy of information, and also correspondingly proposes a new informational interpretation of scientific metaphysics. These are applied to numerous outstanding ontological, philosophical, and theoretical problems in the philosophy of information, scientific realism, cognitive science, theories of semantic information, and informational logic. The book investigates known and new problems, and advances debates and insights in the philosophy of information. This study investigated attitudes toward the use of deception in negotiation, with particular attention to the distinction between deception regarding the informational elements of the interaction (e.g., lying about or misrepresenting needs or preferences) and deception about emotional elements (e.g., misrepresenting one's emotional state). We examined how individuals judge the relative ethical appropriateness of these alternative forms of deception, and how these judgments relate to negotiator performance and long-run reputation. Individuals viewed emotionally misleading tactics as more ethically appropriate to (...) use in negotiation than informational deception. Approval of deception predicted negotiator performance in a negotiation simulation and also general reputation as a negotiator, but the nature of these relationships depended on the kind of deception involved. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. The debate regarding the role of conscientious objection in healthcare has been protracted, with increasing demands for curbs on conscientious objection. There is a growing body of evidence that indicates that in some cases, high rates of conscientious objection can affect access to legal medical services such as abortion—a major concern of critics of conscientious objection. Moreover, few solutions have been put forward that aim to satisfy both this concern and that of defenders of conscientious objection—being expected to participate in (...) the provision of services that compromise their moral integrity. Here we attempt to bring some resolution to the debate by proposing a pragmatic, long-term solution offering what we believe to be an acceptable compromise—a quota system for medical trainees in specialties where a conscientious objection can be exercised, and is known to cause conflict. We envisage two main objectives of the quota system we propose. First, as a means to introduce conscientious objection into countries where this is not presently permitted. Second, to minimise or eliminate the effects of high rates of conscientious objection in countries such as Italy, where access to legal abortion provision can be negatively affected. (shrink)

Systems Theory analyses the world in terms of communications and divides the natural world into environment and systems. Systems are characterised by their high density of communications and tend to become more complex and efficient with time, usually by means of increased specialisation and coordination of functions. Management is an organisational sub-system which models all necessary aspects of organisational activity such that this model may be used for monitoring, prediction and planning of the organisation as a whole. The function of (...) a specific management system depends on its history of selection by interactions with the environment (which includes other systems). The main function of a management system will be a consequence of the most powerful and sustained selection pressure it has experienced. Systems Theory implies a management science which is quantitative and comparative. It is quantitative because it is based upon the measurement and mapping of communications as the basis of analysis; it is comparative because evaluations relate to specific variables measured in a specific spatio-temporal context and subjected to analytic processes of constrained complexity. Selection processes are broadly responsible for the dominance of management in contemporary Western societies. The complexity of management systems will probably continue to increase for as long as the efficiency-enhancing potential of complexity outweighs its increased transaction costs. (shrink)

Philosophy long sought to set knowledge on a firm foundation, through derivation of indubitable truths by infallible rules. For want of such truths and rules, the enterprise foundered. Nevertheless, foundationalism's heirs continue their forbears' quest, seeking security against epistemic misfortune, while their detractors typically espouse unbridled coherentism or facile relativism. Maintaining that neither stance is tenable, Catherine Elgin devises a via media between the absolute and the arbitrary, reconceiving the nature, goals, and methods of epistemology. In Considered Judgment, she (...) argues for a reconception that takes reflective equilibrium as the standard of rational acceptability. A system of thought is in reflective equilibrium when its components are reasonable in light of one another, and the account they comprise is reasonable in light of our antecedent convictions about the subject it concerns.Many epistemologists now concede that certainty is a chimerical goal. But they continue to accept the traditional conception of epistemology's problematic. Elgin suggests that in abandoning the quest for certainty we gain opportunities for a broader epistemological purview--one that comprehends the arts and does justice to the sciences. She contends that metaphor, fiction, emotion, and exemplification often advance understanding in science as well as in art. The range of epistemology is broader and more variegated than is usually recognized. Tenable systems of thought are neither absolute nor arbitrary. As a publisher, you come to learn that those who have taught courses on what they’re writing about tend to do a better job than those who haven’t, especially when it comes to books, like this one, intended for a wider audience.

The current paper synthesizes theory and data from the field of life history (LH) evolution to advance a new developmental theory of variation in human LH strategies. The theory posits that clusters of correlated LH traits (e.g., timing of puberty, age at sexual debut and first birth, parental investment strategies) lie on a slow-to-fast continuum; that harshness (externally caused levels of morbidity-mortality) and unpredictability (spatial-temporal variation in harshness) are the most fundamental environmental influences on the evolution and development of LH (...) strategies; and that these influences depend on population densities and related levels of intraspecific competition and resource scarcity, on age schedules of mortality, on the sensitivity of morbidity-mortality to the organism’s resource-allocation decisions, and on the extent to which environmental fluctuations affect individuals versus populations over short versus long timescales. These interrelated factors operate at evolutionary and developmental levels and should be distinguished because they exert distinctive effects on LH traits and are hierarchically operative in terms of primacy of influence. Although converging lines of evidence support core assumptions of the theory, many questions remain unanswered. This review demonstrates the value of applying a multilevel evolutionary-developmental approach to the analysis of a central feature of human phenotypic variation: LH strategy. (shrink)

In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Introduction. During the past two decades philosophers of psychology have considered a large variety of computational models for philosophy of mind and more recently for cognitive science. Among the suggested models are computer programs, Turing machines, pushdown automata, linear bounded automata, finite state automata and sequential machines. Many philosophers have found finite state automata models to be the most appealing, for various reasons, although there has been no shortage of defenders of programs and Turing machines. A paper by Arthur Burks (...) convinced me long ago that “all natural human functions” are, or can be fruitfully modeled to be, finite state automata with output. Further work in the field has reinforced this conviction. There is room, however, for the use of any of the above models in philosophy of mind and in the ongoing development of cognitive science. Earth is changing in ways it hasn't for hundreds of thousands of years. At the same time, Christianity is breaking away from its millennium-long geographical and cultural center in the Euro-West. The development of artificial womb technology is proceeding rapidly and will present important ethical and theological challenges for Christians. While there has been extensive secular discourse on artificial wombs in recent years, there has been little Christian engagement with this topic. There are broadly two primary uses of artificial womb technology—ectogestation as a form of enhanced neonatal care, where some of the gestation period takes place in an artificial womb, and ectogenesis, where the entire gestation period is within an artificial (...) womb. Ectogestation for the latter weeks or months of pregnancy could be possible within a decade or so, while ectogenesis for humans is far more speculative. Ectogestation is likely to significantly decrease maternal and neonatal morbidity and mortality, and so there is a strong case for supporting its development. Ectogenesis, however, may bring a number of challenges, including the commodification of children, and the pathologizing of pregnancy and childbirth. Its long-term effects on those who are created through this process are also unknown. In the event that it becomes ubiquitous, we may also find the central theological significance of pregnancy and birth diminished. In November 2018, the practice of health care ethics consultation crossed a major threshold when 138 candidates took the inaugural Healthcare Ethics Consultant Certification Examination. This accomplishment, long in the making, has had and continues to have both advocates and critics. The Healthcare Ethics Consultant Certification Commission, a functionally autonomous body created and funded by the American Society for Bioethics and Humanities, was charged with overseeing creation of the certification process, developing the exam, and formulating certification standards and policies (...) to assess candidates’ qualifications. In this essay, as members of the commission, we describe the process of developing, administering, and scoring the certification examination as well as the historical context and the outlook for certification. By detailing the decisions and actions of the commission, we aim to provide a transparent account of the commission's efforts to develop a psychometrically sound, reliable, and secure examination through a deliberative, fair, and data‐driven process. Quantum theory offers mathematical descriptions of measurable phenomena with great facility and accuracy, but it provides absolutely no understanding of why any particular quantum outcome is observed. It is the province of genuine explanations to tell us how things actually work—that is, why such descriptions hold and why such predictions are true. Quantum theory is long on the what, both mathematically and observationally, but almost completely silent on the how and the why. What is even more interesting is that, (...) in some sense, this state of affairs seems to be a necessary consequence of the empirical adequacy of quantum descriptions. One of the most noteworthy achievements of quantum theory is the accurate prediction of phenomena that, on pain of experimental contradiction, have no physical explanation. It is the purpose of this essay to make clear why quantum mechanics and quantum field theory are complete physical descriptions that describe the metaphysical incompleteness of the physical world, then to press the negative implications of this fact for naturalistic metaphysics. Little is gained, and much lost, by casting an empirical theory of consciousness in a "functionalist" philosophical mold. Consciousness Explained is an instructive failure. It resurrects various behaviorist dogmas; it denies consciousness any distinct cognitive ontology; it obliquely adopts many long-standing research positions relating parallel and sequential processing to consciousness, yet denies the core assumption which produced this research; it takes parallel processing to be incompatible with educated common-sense views of consciousness , while in fact parallel processing is compatible (...) with some Cartesian Theater views. Contrary to Dennett, the Cartesian Theater does not necessarily imply that contents must fully "arrive" in consciousness at a single, specifiable instant; criticism of the Cartesian Theater based on this attribution is thus without force. And if consciousness is a distinct information-bearing medium, functionalist attempts to "explain" consciousness are inherently inadequate. (shrink)

There has long been scholarly disagreement about how well book one of the Republic fits together with the books that follow. An extreme view finds book one seriously at odds with the rest of the Republic in both philosophical content and argumentative method. The position taken here is that the dialogue is highly unified in both philosophical content and argumentative method. The central doctrines of the later books are contained in book one in compressed form, and the argumentative method (...) of book one, taken as a whole, does not differ substantially from the argumentative method of the later books. Charles Demuth is widely recognized as one of the most significant American modernists. His precisionist cityscapes, exquisite flowers, and free-wheeling watercolors of vaudeville performers, homosexual bathhouses, and cabaret scenes hang in many of the country's most prestigious collections, including the Metropolitan Museum of Art, the Philadelphia Museum of Art, the Columbus Museum of Art, the Amon Carter Museum in Fort Worth, the Art Institute of Chicago, and in Demuth's Lancaster, Pennsylvania, family residence, now home of the Demuth Foundation. At a (...) time when many American artists remained tied to Europe, Demuth "Americanized" European modernism. This collection of 155 of his letters offers valuable views of the arts and letters colonies in Provincetown, New York, and Paris. Besides offering information on Demuth's own works, the letters also shed light on the output of his contemporaries, as well as references to their trips, liaisons, and idiosyncrasies. Demuth numbered among his correspondents some of the most famous artists and writers of his time, inluding Georgia O'Keeffe, Eugene O'Neill, John Reed, Gertrude Stein, Alfred Stieglitz, Carl Van Vechten, and William Carlos Williams. In his travels in the United States and abroad, he encountered many other talented contemporaries: Peggy Bacon, Muriel Draper, Marcel Duchamp, the Stettheimer sisters, artists and writers, patrons, and gallery owners. Whether he is offering to pick up a copy of Joyce'sUlyssesfor Eugene O'Neill or trying to convince Georgia O'Keeffe to decorate his music room, Demuth is always in the thick of art and literary life. Flamboyant in attire but descreet in his homosexuality, Demuth also reveals in his letters the life of a talented homosexual in the teens and twenties. With his best friends Robert Locher and Marsden Hartley, he circulated through the art colonies of Greenwich Village, Provincetown, and Paris, meeting everyone. The book also contains reprints of some short appraisals of Demuth and his work that were published during his lifetime, long out of print, including pieces by A. E. Gallatin, Angela E. Hagen, Marsden Hartley, Helen Henderson, Henry McBride, Carl Van Vechten, Rita Wells, and Willard Huntington Wright. In a Special Issue of Discourse Studies titled ‘The Epistemics of Epistemics’, contributing authors criticize Heritage’s research on participants’ orientations to, and management of, the distribution of knowledge in conversation. These authors claim that the analytic framework Heritage developed for analyzing epistemic phenomena privileges the analysts’ over the participants’ point of view, and rejects standard methods of conversation analysis ; that and are adopted in developing and defending the use of abstract analytic schemata that offer little purchase on either the (...) specific actions speakers accomplish or the understanding others display of them; and that, by virtue of these deficiencies, claims about the systematic relevance of epistemic phenomena for talk-in-interaction breach long-standing norms regarding the relationship between data analysis and generalizing claims. Using a collection of excerpts bearing on the import of epistemics for action formation and action sequencing, I demonstrate that these claims are patently false and suggest that they reflect the authors’ effort to recast CA as a kind of fundamentalist enterprise. I then consider excerpts from a second collection to illustrate how the form of social organization described by Heritage can be used to explicate other phenomena that depend on systematic alterations to its basic features. In conclusion, I suggest that CA’s success in enhancing our grasp of the organization of talk-in-interaction derives from its unique commitment to both generalization and context specificity, collections and single cases, findings plus a continual openness to the ‘something more’ that each particular case can provide. Several of the contributions to the Lynch et al. Special issue make the claim that conversation-analytic research into epistemics is ‘routinely crafted at the expense of actual, produced and constitutive detail, and what that detail may show us’. Here, we seek to address the inappositeness of this critique by tracing precisely how it is that recognizable actions emerge from distinct practices of interaction. We begin by reviewing some of the foundational tenets of conversation-analytic theory and method – including the relationship (...) between position and composition, and the making of collections – as these appear to be primary sources of confusion for many of the contributors to the Lynch et al. Special Issue. We then target some of the specific arguments presented in the Special Issue, including the alleged ‘over-hearer’s’ writing of metrics, the provision of so-called ‘alternative’ analyses and the supposed ‘crafting’ of generalizations in epistemics research. In addition, in light of Lynch’s more general assertion that conversation analysis has recently been experiencing a ‘rapprochement’ with what he disparagingly refers to as the ‘juggernaut’ of linguistics, we discuss the specific expertise that linguists have to offer in analyzing particular sorts of interactional detail. The article as a whole thus illustrates that, rather than being produced ‘at the expense of actual, produced and constitutive detail’, conversation-analytic findings – including its work in epistemics – are unambiguously anchored in such detail. We conclude by offering our comments as to the link between CA and linguistics more generally, arguing that this relationship has long proven to be – and indeed continues to be – a mutually beneficial one. At its inception innocent of philosophical or metaphysical designs, the Gaia hypothesis of James Lovelock and Lynn Margulis was soon liberated from the precincts of scientific cultivation to enter into cultural free association. Nonetheless, scientific and scholarly attention and debate have long precipitated a bona fide discourse of Gaia theory. Moreover, intellectually serious extra-scientific figures of Gaia have also been on the rise in the last decade. This essay treats a selection of these newer Gaian figures, specifically, Isabelle Stengers’s (...) Gaia the Intruder and Bruno Latour’s secular Gaia, in relation to Lovelock’s Gaia and Lynn Margulis’s evocations of autopoietic Gaia. When nuanced through second-order systems theory, the discourse of autopoietic Gaia satisfies Stengers’s and Latour’s demands for a non-holistic, heterogeneous yet coherent Gaia concept fit for communicative efficacy in the so-called Anthropocene epoch. The elections for the provincial councils, held on the 10th of March 1974, has shown results that are quite similar to those shown by the parliamentary elections. Traditional parties keep or reinforce their positions, whereas the linguistic parties suffer a setback-clear-cut in the case of the Rassemblement Wallon and the Front Démocratique des Bruxellois, but only limited for the Volksunie, which has a long-standing Flemish-nationalist tradition.

L’émergence des marchés en Europe de l’Est, en Asie et celle du cyber-espace ne se fait pas avec la rapidité que beaucoup d’observateurs voudraient. La lenteur de ce développement provient de l’environnement institutionnel : les systèmes législatifs ne soutiennent pas les droits de propriété privée et ne font pas plus respecter les contrats. Ainsi, beaucoup soutiennent que les Etats doivent intensifier leurs efforts pour établir un droit commercial. En réalité, il faut réclamer un désengagement de l’Etat dans le droit commercial. (...) Tout au long de l’histoire, le recours efficace de l’activité commerciale est toujours provenu d’un système polycentrique de droit coutumier avec des querelles résolues par le biais de cours de commerce ou d’arbitrage eux-mêmes appuyés par des sanctions d’ostracisme imposées de façon privée, et il en est de même pour le droit commercial international aujourd’hui. Nous proposons une description des institutions et des processus du droit commercial international, suivie de discutions sur la nécessité d’un droit polycentrique et des caractéristiques du droit coutumier. Finalement, nous expliquons pourquoi nous devrions compter sur un système de droit coutumier polycentrique sans Etat pour l’émergence récente des marchés.The emergence of markets in Eastern Europe, Asia, and cyberspace is no occurring as rapidly as many observers would like. Slow development is a function of the institutional environment: legal systems do not support private property rights or enforce contracts. Thus, many contend that states must step up their efforts to establish commercial law. In reality, less state involvement in commercial law is called for. Throughout history effective recourse for commercial activity has been produced through a polycentric system of customary law with disputes resolved through merchant courts or arbitration backed by privately imposed ostracism sanctions, and the same is true for international commercial law today. A description of the institutions and processes of international commercial law is provided, followed by discussions of the desirability of polycentric law and the characteristics of customary law. Finally, an explanation is provided for why a stateless system of polycentric customary law should be relied upon in modern emerging markets. (shrink)
